TERMS OF SERVICE TH LEGAL

1. DEFINITIONS
Whenever the terms listed in Section 1 are used in these Regulations, they shall be understood as defined below.
1.1. Personal Data or Data – personal data within the meaning of the RODO.
1.2. User – means any natural person visiting the Website or using one or more of the functionalities described in the Regulations.
1.3. Privacy Policy – the privacy policy of the Website.
1.4. Regulations – these regulations of the TH LEGAL Service.
1.5. RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC.
1.6. Service – a website with a collection of all data, information, content and functionality available through it, located at: theheart.legal
1.7. TH LEGAL – a company operating under the name of TH LEGAL JKOZIOŁ spółka komandytowa with its registered office in Warsaw, ul. Rondo Ignacego Daszyńskiego 1, P.29 (00-843, Warsaw), entered in the Register of Entrepreneurs kept by the District Court for the city of Warsaw. Warsaw, XIII Economic Department of the National Court Register, under the KRS number 0000999243, having NIP number 5273025326 and REGON number 523499210. 2. GENERAL PROVISIONS
2.1. These Regulations are the regulations referred to in Art. 8 of the Law of July 18, 2002. on the provision of electronic services and sets out the terms and conditions for the provision of electronic services through the Service.
2.2. The entity operating the Service is TH LEGAL.
2.3. These Regulations are made available free of charge on the Website in a form that allows free recording, storage and reproduction by the User using the TH LEGAL Website.
2.4. TH LEGAL provides a Service that presents information about TH LEGAL. The TH LEGAL service is both informational in nature for the presentation of TH LEGAL’s services and also allows you to make inquiries using the contact form and allows you to submit your resume using the resume form.
2.5. The Regulations set out the rules for the use of the Website by Users, as well as the rules for the use of additional functionalities.
2.6. Use of the Service by the User implies acceptance of these Terms and Conditions.
2.7. The use of the Website by the User is possible provided that the ICT system used by the User meets the minimum technical requirements, i.e. using a mobile device with Internet access and equipped with an Internet browser.
2.8. The service is available on a continuous basis, subject to the right to temporary shutdowns caused by failure, maintenance, upgrades or technical requirements.
2.9. TH LEGAL shall not be liable for any malfunction or unavailability of the Service due to the causes indicated in 2.7. and due to other causes beyond the control of TH LEGAL.

3. USE OF THE SERVICE
3.1. The user is obliged to use the Service in accordance with the law and good morals, taking into account personal property and intellectual property rights, in particular copyright, vested in TH LEGAL or third parties.
3.2. The user is obliged not to take any action that could affect the proper functioning of the Service. In particular, it is forbidden to interfere in any way with the content posted on the Website.
3.3. It is forbidden for Users to provide unlawful content using the Service.
3.4. It is forbidden in the use of the Service to provide false, inaccurate or outdated information or Personal Data.
3.5. It is forbidden to disseminate false or illegal information about the content posted on the Service.
3.6. It is forbidden to violate in any way the personal rights of TH LEGAL, its employees, its affiliates or third parties.
3.7. No fees are charged or collected from Users for using the Service.

4 FORMS
4.1. In order to contact TH LEGAL, please fill out the contact form, located in the “Contact Us” tab, providing the data marked with an asterisk in the form as mandatory, and then send a message by clicking the “Send Message” button.
4.2. In order to participate in the recruitment processes of TH LEGAL, you should send your recruitment application through the CV form, located in the “Contact Us” tab, providing the data marked with an asterisk in the form as mandatory.
4.3. Only adults with full legal capacity may submit forms to the Website.
4.4. By completing and submitting forms on the Website, the User declares that he/she has read and accepts the content of the Terms and Conditions.

5. COMPLAINTS
5.1. In case of noticing irregularities in the functioning of the Service, the User has the right to report objections and errors to the e-mail address: office@theheart.legal, providing a description of the irregularities detected.
5.2. The user using the service of submitting an inquiry through the contact form has the right to submit complaints about this service to: office@theheart.legal.
5.3. Applications and complaints referred to in 5.1. and 5.2., should include a detailed description of the problem occurring and the User’s contact information to enable TH LEGAL to provide a response to the request made by the User.
5.4. TH LEGAL may ask the User to provide additional information to the extent necessary to respond.
5.5. Upon receipt by TH LEGAL of the complaint or application referred to in 5.1. i 5.2. They will be promptly processed, but no later than two weeks from the date of receipt of full information.
5.6. Detailed information on the User’s alternative methods of handling complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and websites of local consumer ombudsmen, social organizations dealing with consumer protection, Provincial Inspectorates of Commercial Inspection, as well as at: www.uokik.gov.pl.
5.7. In the case of a consumer dispute arising from electronic services, the User may use the “Online Dispute Resolution” (ODR) platform available in the European Union. This tool makes it possible to resolve a dispute amicably, eliminating the need to attend court. The ODR platform is available at: www.ec.europa.eu/odr.

6. INTELLECTUAL PROPERTY RIGHTS AND PERSONAL DATA PROCESSING
6.1. TH LEGAL reserves the copyright to all information and materials available on the Website. Use of this content is permitted only within the scope of permitted personal use by the User. It is forbidden to copy, reproduce, distribute on the Internet and any other use of materials and information posted on the Website that exceeds the limits allowed by law.
6.2. Personal data of Users using the services available through the Website are processed in accordance with the principles described in the Privacy Policy.

7. FINAL PROVISIONS
7.1. The User may contact TH LEGAL by contacting TH LEGAL in the traditional form at TH LEGAL’s address or via e-mail address: office@theheart.legal or the contact form available on the Website.
7.2. The Terms and Conditions are made available free of charge for download in electronic format, in PDF format on the Website, in order to enable Users to store and reproduce them in the ordinary course of business.
7.3. TH LEGAL shall not be liable for the non-performance or improper performance of its obligations under these Terms and Conditions, provided that the non-performance or improper performance is caused by circumstances beyond TH LEGAL’s control despite exercising due diligence (force majeure). In particular, events such as strike, war, state of emergency, state of epidemics, floods, fires, tornadoes are considered cases of force majeure. The above includes both cases of force majeure occurring directly on the part of TH LEGAL, as well as on the part of TH LEGAL’s suppliers, subcontractors and other collaborators. In the event of force majeure, performance of the obligation may be suspended for a period equal to the period of force majeure.
7.4. TH LEGAL is not responsible in particular for:
7.4.1. any damage caused to third parties as a result of the User’s use of access to services in a manner contrary to the Regulations or applicable laws,
7.4.2. any damage caused to third parties as a result of the User providing false data in the contact form or resume form on the Website,
7.4.3. For inability to use the Service caused by the User’s failure to meet the technical requirements indicated in the Regulations.
7.5. TH LEGAL shall be entitled to amend the provisions of the Terms and Conditions at any time, in particular in the event of the occurrence of any of the valid reasons indicated below:
7.5.1. The need to adapt the Regulations to the law,
7.5.2. changes in the scope of services provided on the Site,
7.5.3. changes to the technical conditions of use of the Service.
7.6. TH LEGAL will inform the User of any change to the Regulations 14 days before the new Regulations take effect. Amendments will also be published in the form of a unified text with information about their implementation in the Service.
7.7. The regulations enter into force on March 12, 2024.
7.8. Disputes arising from the Regulations, which could not be resolved between Users and TH LEGAL by amicable means, will be settled by a common court of competent jurisdiction according to the provisions of Polish law. All correspondence, statements, records and other such verbal communication will be in Polish.
